Welcome to Bugs By Charlotte ("Bugs By Charlotte", "we", "our" or "us"). By engaging our services, submitting an enquiry, registering as a family or candidate, or using our website, you agree to these Terms & Conditions.
1. Our Services
Bugs By Charlotte is a boutique nanny agency that connects families with carefully screened nannies, babysitters, au pairs, tutors and household support professionals.
While we take every reasonable step to assess candidates, Bugs By Charlotte acts as an introduction and placement agency and is not the employer of the nanny unless otherwise agreed in writing.
2. Family Responsibilities
Families agree to:
Provide accurate information regarding their household and childcare requirements.
Maintain a safe, respectful and lawful working environment.
Treat all candidates fairly and with respect.
Comply with all applicable Australian employment and workplace laws.
Pay the nanny directly unless otherwise agreed with Bugs By Charlotte.
Notify Bugs By Charlotte if a placement becomes permanent, changes significantly or is terminated.
3. Candidate Responsibilities
All candidates must:
Be legally entitled to work in Australia.
Provide truthful and accurate information.
Hold valid identification.
Hold a current Working With Children Check where required.
Maintain current First Aid and CPR qualifications where requested.
Provide genuine professional references.
Immediately notify Bugs By Charlotte if any information supplied changes.
Providing false or misleading information may result in removal from our database without notice.
4. Recruitment Process
Bugs By Charlotte carefully reviews all applications and may conduct interviews, reference checks, qualification verification and background screening where appropriate.
Submitting an application does not guarantee employment or placement.
We reserve the right to decline any application without providing reasons.
5. Trial Shifts
Families may request a paid trial shift before confirming a placement.
Trial shifts:
Must be paid by the family;
Do not guarantee ongoing employment; and
May be terminated by either party at any time.
6. Placement Fees
Where applicable, placement fees become payable once a family offers employment to a candidate introduced by Bugs By Charlotte.
Placement fees are non-refundable unless otherwise agreed in writing.
7. Direct Engagement
Candidates introduced through Bugs By Charlotte remain introductions made by our agency.
Families agree not to employ, engage or otherwise contract a candidate introduced by Bugs By Charlotte outside the agency process without paying the applicable placement fee.
This applies whether the engagement occurs immediately or within 12 months of the introduction.
8. Cancellations
Families should provide as much notice as possible if cancelling a booking.
Late cancellations may incur cancellation fees in accordance with our booking policy.
Likewise, candidates are expected to provide reasonable notice if they are unable to attend a booking.
Repeated cancellations or no-shows may result in removal from the Bugs By Charlotte network.
9. Payments
Families agree to pay all invoices issued by Bugs By Charlotte by the due date.
Where nannies invoice families directly, payment terms are between the family and the nanny.
Late payments may incur interest and debt recovery costs where permitted by law.
10. Confidentiality
All personal information exchanged between Bugs By Charlotte, families and candidates must remain confidential.
Neither party may disclose private information, addresses, phone numbers, children's details or personal circumstances except where reasonably necessary.
11. Professional Conduct
Families and candidates agree to behave respectfully and professionally at all times.
Bullying, harassment, discrimination, abuse, violence, intimidation or inappropriate behaviour will not be tolerated and may result in immediate termination of services.
12. Child Safety
The safety and wellbeing of children is our highest priority.
Families and candidates must comply with all applicable child protection laws.
Any concerns relating to child safety must be reported immediately.
13. Limitation of Liability
While Bugs By Charlotte carefully screens candidates, we cannot guarantee the future conduct, suitability or performance of any individual.
Families are responsible for making their own employment decisions.
To the maximum extent permitted by law, Bugs By Charlotte is not liable for:
Injury or loss arising from a placement;
Damage to property;
Employment disputes;
Payroll obligations;
Taxation matters;
Superannuation obligations;
Workplace claims; or
Indirect or consequential loss.
14. Insurance
Families are responsible for ensuring they have any insurance required for employing a nanny within their home.
Candidates are responsible for maintaining any personal insurance they require.
15. Privacy
All personal information collected by Bugs By Charlotte is handled in accordance with our Privacy Policy and applicable Australian privacy legislation.
16. Intellectual Property
All website content, branding, documents, photographs, logos and recruitment materials remain the property of Bugs By Charlotte.
They may not be copied, reproduced or distributed without written permission.
17. Changes to These Terms
Bugs By Charlotte reserves the right to amend these Terms & Conditions at any time.
Updated versions will be published on our website and become effective immediately upon publication.
18. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
